Ourpot Terms of Use

Licence

These Terms of Use are the end-user licence agreement between you and Idion for the Ourpot app. By downloading or using Ourpot, you accept them.

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Ourpot for your own use. If you obtained Ourpot from the Apple App Store, this licence is limited to use on Apple-branded devices that you own or control, and is subject to the Usage Rules in the Apple Media Services Terms and Conditions, including any permitted family sharing. If you obtained Ourpot from Google Play, the equivalent Google Play terms apply.

You may not sell, rent, sublicense, or redistribute Ourpot, or copy, modify, decompile, or reverse engineer it except to the extent that applicable law expressly permits. Our Acceptable Use Policy describes further behaviour that is not allowed.

Eligibility

You must be old enough to enter into a binding agreement where you live in order to use Ourpot. If you are using it on behalf of someone else, you confirm you are authorised to accept these terms for them.

Accounts

You can use Ourpot without signing up; an anonymous account is created for you. If you save your account with an email address, you are responsible for keeping access to it secure, and for what happens under it. Tell us promptly if you believe someone else has gained access. An anonymous account that is not saved cannot be recovered if you lose your device or delete the app.

We may suspend or close an account that is being used in breach of these terms or our Acceptable Use Policy. You can delete your own account at any time, as described on our Account Deletion page.

Acceptable use

You agree to use Ourpot lawfully and as intended. Our Acceptable Use Policy sets out what is not allowed, and it forms part of these terms.

Your content and shared pots

You keep ownership of what you add to Ourpot. You grant us the licence we need to store it, process it, and show it to you and to the other members of the pots you add it to, so the app works. Everything in a pot is visible to its members, and the owner of a pot can remove members from it.

You are responsible for what you submit, and you confirm you have the right to submit it. We may remove content that breaches these terms or our Acceptable Use Policy. You can leave any pot at any time, and you can report misuse to [email protected].

Feedback

If you send us suggestions about Ourpot, we may use them without obligation to you. This does not affect your rights in anything else you create.

AI-generated recaps

Pot Coach uses AI to write recaps and ideas from your pot's figures. They are informational and generated automatically. They can be incomplete or wrong, they are not professional advice of any kind, and decisions you take remain yours. See our AI Policy.

Not financial advice

Ourpot is not a regulated financial adviser and does not provide financial, investment, tax, or legal advice. It does not move money, does not connect to your bank, and does not act on your behalf. Balances, budgets and "who owes whom" are calculated only from what the members of a pot entered; they are not a statement of any legal debt, and marking something as paid in the app records a payment rather than making one. Decisions about your money remain yours.

Subscriptions

Ourpot offers an optional paid subscription, Ourpot Plus, billed weekly or yearly. Prices, billing periods, and any free trial are shown in the app before you buy, and payment is taken by the Apple App Store or Google Play under their terms.

Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. You can cancel at any time in your device's subscription settings, and cancelling stops the next renewal rather than ending the period you have already paid for. If a free trial is offered, any unused part of it ends when you buy a subscription. Refunds are handled by the store you bought from, under its own policy, except where the law where you live gives you a further right of withdrawal.

Plus benefits apply to every member of a pot while the subscriber is an active member of it. If the subscriber leaves the pot or the subscription ends, the pot returns to the free plan: nothing already recorded is deleted, but Plus features such as recurring entries stop.

Intellectual property

Ourpot, including its software, design, and content, belongs to Idion and its licensors, and is protected by intellectual property law. These terms grant you a licence to use it, not any ownership of it.

If a third party claims that Ourpot infringes their intellectual property rights, we, not Apple or Google, are solely responsible for investigating, defending, settling, and discharging that claim.

Availability

We aim to keep Ourpot available, but we do not guarantee it will be uninterrupted or error-free. Access may be limited by maintenance, by problems outside our control, or by your own device or connection.

Changes to the service

We may change, add, or remove features as Ourpot develops. Where a change materially reduces what a paid subscription provides, we will make a reasonable effort to tell you in advance.

Third-party services

Ourpot may link to services we do not operate, such as the app store's subscription settings or your email app. We are not responsible for their content or their practices, and their own terms and privacy policies apply when you use them.

Third-party terms

You confirm that you are not located in a country subject to a United States government embargo, or designated by the United States government as a terrorist-supporting country, and that you are not on any United States government list of prohibited or restricted parties.

You must comply with any applicable third-party terms of agreement when using Ourpot. Apple and Google, and their subsidiaries, are third-party beneficiaries of these Terms of Use and, upon your acceptance, will have the right to enforce them against you.

Termination

You may stop using Ourpot at any time and delete your account. We may suspend or end your access if you breach these terms, if we are required to by law, or if we discontinue the app. Terms that by their nature should survive termination do so.

Disclaimers

Ourpot is provided on an "as is" and "as available" basis. To the extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Nothing here limits rights you have under consumer law that cannot be limited.

Limitation of liability

To the extent permitted by law, Idion is not liable for indirect, incidental, special, or consequential losses, or for loss of data or profits, arising from your use of Ourpot. Our total liability for any claim relating to Ourpot is limited to the amount you paid us for it in the twelve months before the claim.

Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

Disputes

If something goes wrong, contact us first at [email protected]. Most problems are resolved that way and it is faster for both of us.

If we cannot resolve it informally, the courts identified below have jurisdiction. If you are a consumer in the European Union, this does not deprive you of the protection of the mandatory rules of the country where you live.

Governing law

Ourpot is operated by Idion, based in Spain. These terms are governed by the laws of Spain, and the courts of Spain have jurisdiction, without prejudice to any mandatory consumer protection you have where you live.

Export compliance

You may not use or export Ourpot except as permitted by the laws of Spain, the European Union, and the United States, and by the laws of the place where it was obtained.

App store terms

If you downloaded Ourpot from the Apple App Store or Google Play, the following also applies. These terms are an agreement between you and Idion only, not with Apple or Google, and Apple and Google are not responsible for Ourpot or its content.

Apple and Google have no obligation to provide maintenance or support for Ourpot. In the event Ourpot fails to conform to any warranty, you may notify Apple or Google, and they may refund the purchase price, if any, but that is their only warranty obligation, and any other claims, losses, or damages are our sole responsibility, not theirs.

Apple and Google are not responsible for addressing any claims relating to Ourpot, including product liability claims, claims that Ourpot fails to meet applicable legal or regulatory requirements, or claims under consumer protection law. Apple and Google are third-party beneficiaries of these terms and, upon your acceptance, will have the right to enforce them against you.

Maintenance and support for Ourpot is our sole responsibility. Apple and Google have no obligation to provide it, and questions should be sent to the support address below.
